When identification and record duties apply
Certain visual depictions involving actual performers fall within the age-verification and record-keeping requirements of 18 U.S.C. 2257 and 2257A. Where those provisions apply, records concern performer identification, birth dates, names and aliases, together with where the records are maintained.
Whether a requirement applies depends on the material and how it was produced. Calling a tool or feature AI does not establish that every item made with it is exempt.
